Public Security and Individual Rights
Given the particular features of macro-crime and the grave threat it poses to public security, the fight against macro-criminal phenomena has given rise to an extensive special legal framework, which is applied in various areas of criminal justice, such as judicial ascertainment, criminal execution and prevention. A “double-track” approach that has resulted in legislative choices – both procedural and substantial – arousing serious doubts concerning their compatibility with national constitutional principles and international conventions.
Thanks to this cluster, Macrocrimes is able to engage in in-depth study on the main critical issues, also with a view to proposing legislative amendments.
